Working Visa - Netherlands work permit for a non-EEA national, it is normally necessary to show that attempts have been made to fill the position from the local and EEA labour markets. These attempts should include advertising in national newspapers, websites, industry publications, etc. However, the local employment service, or Arbeitsamt, will run searches for EU nationals with the appropriate skills by using the European Employment Services placement network (EURES). Usually Dutch employers should also have looked into training existing employees.

Residence Visa (Naturalisation) - The Netherlands Embassy must obtain approval for the issuance of a temporary residence permit from the immigration authorities in the Netherlands. It is important that you apply for the temporary residence permit at least three months prior to your intended stay in the Netherlands. If you will not be working you will need to show that you have sufficient funds to support yourself while you are living in the Netherlands.

Holiday Visa - Holiday visas are not generally appropriate for filling vacancies so senior that you would otherwise consider a full work permit; they are only available for citizens of Canada, Australia and New Zealand. The intention behind the scheme is to allow young (age 18-30) Australians, Canadians and New Zealanders to visit the Netherlands for up to 12 months and to permit them to supplement their income by working during their holiday, which should be their main purpose of travel.

Immigration to South Africa : With the brain drain from the Republic of South Africa, the country has a great need to import skilled staff. To that end, the Immigration Act implemented on 7 April 2003 is an attempt to simplify the issuance of permits, to attract skilled and qualified foreigners to the Republic and to promote tourism in the RSA.

Work permits applications for South Africa are dealt with by the Department of Home Affairs. However, the South African authorities have delegated intra company transfer applications (where the worker is moving within the same international group) and secondment (where a foreign firm sends an employee to a client's site in South African in accordance with a service contract) to their High Commissions and Embassies. It is with these applications that workpermit.com can assist.

How long will it take to get a candidate on-site with a South African Work Permit?

Properly presented applications can be processed very quickly, in just over a week. Once the application is approved, the candidate may travel immediately to South Africa to start work.

Can My Company Apply for a Work Permit to Second an employee to South Africa?

There are two types of permit that can be issued by the High Commission:

1. Intra Company Transfer

The company will need to fulfil the following criteria:

Have an established presence in the UK.
Have an established presence in South Africa.
These two companies must be part of the same international group.
The candidate moves from employment in the UK office to be employed in the South African office.

2. Secondments

A UK company may send a consultant to it's South African client to install a product or as part of a contract to provide services to them. Please note the contractor sent to South Africa must genuinely be part of a wider service agreement, for example installing propriety software.

Does the Candidate Qualify to be Seconded to South Africa?

There are no explicit criteria relating to the candidate, however the following items are good rules of thumb by which to judge whether a candidate would be suitable:

They must be able to do the job
They should have worked for the company for at least six months.

This is necessary as most applications are made on the premise of the candidate having specialist knowledge of the companies operations.

How do I apply for a South African Work Permit?

A work permit application is actually an application for a temporary residence permit. They should be submitted in the South African High Commission in the country where the candidate is normally resident.

These applications are quite extensive and will involve producing original signed documents form both the South African and UK offices, the time needed to do this should be factored into plans.

Can my company apply for all types of work permit through the High Commission?

No. It is only possible to make applications for work permits for employees who are being seconded within an international group, (an intra-company transfer)

Can the candidate be accompanied by his/her family?

Yes. However additional documentation will be required.

No. The employer must make a work permit application, and the resulting permit will be employer-specific.

Is it necessary to apply for the visa separately?

No for South Africa the visa is included in the work permit application.

What is the difference between "body shopping" and providing a service?

It is not possible to obtain a work permit for a candidate who is being body shopped, but it is possible for a candidate under a contract to provide services. The key differences are:

The sponsor may not be a recruitment agency.
The staff remain on the payroll and line management of the service provider.
The services are above and beyond that of just a contractor – e.g. consultants assisting in the installation of a propriety product sold to a client.
The services provided must be shown to be in the normal run of operations for the service provider.

What elements should be included in a service contract to ensure that it is suitable for a work permit application?

A provision of service contract should include the following elements:

The day to day line management of the consultants remains with the service provider
It should include warranted deliverables.
It should cover the entire period for which the permit is required.
It should be signed by both parties, and on the client headed paper.

Immigration to Spain : Span has announced a general amnesty for illegal immigrants. By registering with the relevant authorities, formerly illegal immigrants will be able to legitimise their presence in Spain. In consequence, the whole Spanish system is overloaded and processing times have increased significantly.

Spanish work permit procedure is long and complicated, necessitating a decision by many different authorities. However, recent changes to legislation for companies providing services to their clients means that some consultants can be placed on site very quickly.

How long will it take to get an employee on site with an Spanish work permit?

The supporting documentation needed is quite extensive and can take some time to collect, it must be submitted in Spanish, so translations should be taken into both time and financial budgets. Once the application has been lodged, processing takes between 3 and 6 months due to the highly bureaucratic systems designed to protect the resident labour markets.

Spain has just acknowledged the provision of service ruling by the European Court, which means that some candidates may be able to be placed on-site within a week.– See the section below.

When the work permit is approved the candidate must apply for a residence visa to travel to Spain and start work.

Can my company obtain Spanish work permits?

There are two possible ways for the candidate to be employed with a work permit for the first time:

As the direct employee of an Spanish company. In the first instance this would be a type b, which is for a maximum of 1 year. This may be extended and would become a type B, valid for a maximum of 2 years.
As the employee of a foreign company that is providing services to an Spanish company. This foreign company may not be a recruitment agency and must produce a service contract as part of the application. In this scenario, a Spanish accountant must administer the payrolling of the candidate to ensure that all tax and social security is duly paid. This would be a type A permit and would be valid for a maximum of 9 months.

Does the candidate qualify for an Spanish work permit?

The candidate must be shown to have sufficient experience to fill the position.

If the application is for an assignment permit then the candidate should have at least 6-12 months experience with the service provider, to justify the claim that they have experience with the company's systems.

Preference is given to candidates with some demonstrable link with Spain and Latin American citizens

How do I apply for an Spanish work permit?

The application is generally lodged through the Direccion Provincial de Trabajo, seguridad Social y Asuntos Sociales (local labour office), however they may also be lodged at the office for foreigners, the Gereral directorate for Migration, or even the post office. When the application is for provision of service and the employer has no presence in Spain, the Spanish consulate will accept the application.

Once the work permit application is approved, the candidate will need to make a residence visa application in their usual country of residence. The candidate will probably need to present a police clearance certificate and an original birth certificate to be granted this visa, so it is worthwhile assembling these documents in advance.

Provision of service ruling – van der Elst

The European court made a ruling that any EEA company should be able to provide services to it's EEA clients without the need to obtain additional work permits for it's employees. i.e. if a British software house sells it's product to a Spanish company and to install the product on it's client's systems needs to send some non-EEA employees who have UK work permits to the client's offices in Spain they should not need a Spanish work permit.

This ruling is being acknowledged very slowly across Europe, and was acknowledged by Spain at the end of 1999. In order to fit into this category the employee must have been employed in the EEA by the supplier for at least 12 months before being seconded.

There are two nonimmigrant visa categories for people who want to study in the USA. The primary visa is an "F" visa which is for 'academic' studies, and the second one is an "M" visa is for 'nonacademic or vocational' studies.

Course Eligibility
You must have successfully completed a course of study which is typically required for enrollment. Unless you are coming to participate exclusively in an English language training program, you must either be sufficiently proficient in English to pursue the intended course of study, or the school must have made special arrangements for English language courses or teach the course in your native language.

Financial Funding
You must prove that you have sufficient funds or that funds will be available from an identified and reliable financial source to cover the costs of your living and school expenses during the entire period of anticipated study in the United States.

Approved Educational Institutions & Forms
If you are coming to the USA to study, you must be accepted for a full course of study by an educational institution which is ‘approved’ by the INS. The institution you will be attending must send you a Form I-20A-B, Certificate of Eligibility for Nonimmigrant (F-1) Student Status for Academic and Language Students. If you are applying for the nonacademic or vocational visa (M-1), the institution must send you a Form I-20M-N, Certificate of Eligibility for Nonimmigrant Student Status For Vocational Students. The Educational institution you will be attending can obtain Forms I-20A-B and I-20M-N from the INS.

Who is NOT Eligible
The nonimmigrant visa application Form DS-156 lists classes of persons who are ineligible under U.S. law to receive visas. In some instances an applicant who is ineligible, but who is otherwise properly classifiable as a student, may apply for a waiver of ineligibility and be issued a visa if the waiver is approved.

How to Apply for a Student Visa
You should generally apply to the U.S. Embassy or Consulate which has jurisdiction over your place of permanent residence. Although visa applicants may apply at any U.S. consular office abroad, it may be more difficult to qualify for the visa outside the country of permanent residence.

Required Documents
1) An application Form DS-156, completed and signed. (See below for details on obtaining FREE Forms and for current processing fees)

2) A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the USA. If more than one person is included in the passport, each person desiring a visa must make an application;

3) One photograph 1 and 1/2 inches square (37x37mm) for each applicant, showing full face, without head covering, against a light background; and

4) For the "F" applicant, a Form I-20A-B. For the "M" applicant, a Form I-20M-N.

5) Evidence of sufficient funds.

You must pay a nonrefundable application fee (see Forms and Fees below).

Other Documentation Required
You must show to the satisfaction of the consular officer that you have binding ties to a residence in a foreign country which you have no intention of abandoning, and that you will depart the USA when you have completed your studies (i.e. you must show that you intend to return to your homeland after you have completed your studies in the USA).

Employment issues while on a Student Visa
An F-1 student can NOT accept off-campus employment at any time during the first year of study; however, the INS may give you permission to accept off-campus employment after the first year. However, F-1 students can accept on-campus employment from the school without INS permission. Except for temporary employment for practical training, an M-1 student may not accept employment.

Bringing Family Members
Your spouse and unmarried children may also be classified for a nonimmigrant visa to accompany you to the USA. All family members must meet all visa eligibility requirements, including showing the INS that they will have sufficient financial funds for their support, and that they will depart the U.S. when your student education program finishes. Spouses and children of students may not accept employment at any time while in the USA.

Forms Emquiries
You can obtain Forms I-20A-B and I-20M-N from the educational institution. If the institution does not have the forms, it should contact the local INS office.

IMPORTANT INFORMATION
Please note that you can NOT obtain an F-1 visa to attend a U.S. public elementary or middle school (K-8). Anyone who wants to attend public high school (grades 9-12) in the USA on a student visa (F-1), must submit evidence that the local school district has been paid in advance for the unsubsidized per capita cost of the education. Also, attendance at U.S. public high schools cannot exceed a total of 12 months.
Also you can NOT be issued an F-1 visa in order to attend a publicly-funded adult education program.

India is the leading place of origin for international students in USA

According to Open Doors report India is the leading country of origin for international students in the United States. For the second consecutive year, the number of Indian students, this is increased by 12% to 74,603 students followed by china 64,757 students and only 2% increase.
